Terms of Service – White Fox Apothecary

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of White Fox Apothecary's website (www.whitefoxapoth.com), products, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from or use our Services. By using the Services, you represent and warrant that you meet eligibility requirements and have authority to agree to these Terms.

3. Account Registration & Security

You may create an account to facilitate purchases and tracking. You are responsible for maintaining the confidentiality of login credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion.

4. Product Information, Availability & Pricing

We make reasonable efforts to display accurate product descriptions, ingredients, usage instructions, and pricing. Availability, pricing, and promotions are subject to change without notice. We reserve the right to limit quantities, correct errors, and cancel orders (including after submission) if information is inaccurate or the product is unavailable.

5. Health, Safety & Allergy Disclaimer

Our products include room sprays, car freshies, body fragrance, body care, and pet skin care. Always follow usage instructions. Test on a small area first; discontinue use if irritation occurs. Keep out of reach of children and pets unless specifically indicated for pet use. Customers are responsible for reviewing ingredients for possible allergies and sensitivities. Consult a physician or veterinarian as appropriate. {site_name} is not a medical provider and does not provide medical advice.

6. Hazardous Materials & Shipping Compliance

Some products may contain alcohol-based or flammable components subject to shipping restrictions (e.g., ORM-D/limited quantity). You agree to comply with all applicable shipping, handling, and storage guidelines. We may restrict shipping methods or destinations where required by law.

7. Orders, Payment & Taxes

By placing an order, you represent that the information provided is true and accurate and that you are authorized to use the payment method. Prices are listed in USD unless noted. You are responsible for applicable sales/use taxes, duties, and customs fees. We may use third-party processors for payments; their terms may apply.

8. Shipping, Risk of Loss & Title

Orders ship to the address you provide. Title and risk of loss transfer to you upon delivery to the carrier, except where prohibited by law. We are not responsible for delays or loss caused by carriers or incorrect addresses entered by customers. See our Return & Exchange Policy for details, including porch piracy exclusions.

9. Returns & Exchanges

All sales are final. No refunds. Limited one-time exchange available for room sprays and car freshies within 5 days of delivery if at least 75% remains unused and proof of purchase is provided. Body and pet care items are final sale. Original shipping charges are non-refundable; additional shipping fees may apply. See the Return & Exchange Policy for full terms.

10. Intellectual Property

All content on the Services, including text, graphics, logos, images, product names, formulas, and designs, is owned by or licensed to White Fox Apothecary and protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works without our prior written consent.

11. User Content & Reviews

If you submit reviews, comments, images, or other content ("User Content"), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works in any media for marketing and operational purposes. You represent that your User Content is accurate, lawful, non-infringing, and that you have rights to grant this license.

12. Prohibited Conduct

You agree not to: (a) use the Services for unlawful purposes; (b) harass, defraud, or harm others; (c) interfere with site operations, servers, or networks; (d) introduce malware or scrape the site; (e) circumvent security or access non-public areas; (f) use automated means without permission; (g) resell, export, or misuse products contrary to labeling or instructions.

13. Third-Party Links & Services

The Services may link to or integrate with third-party sites and services. We are not responsible for their content, policies, or practices. Accessing third-party services is at your own risk and may be subject to separate terms and privacy policies.

14. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. White Fox Apothecary DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, White Fox Apothecary AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE EVENT.

16. Indemnification

You agree to defend, indemnify, and hold harmless White Fox Apothecary and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your (a) use of the Services or products; (b) violation of these Terms; (c) violation of any law or rights of a third party; or (d) User Content.

17. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, pandemics, supply chain disruptions, governmental actions, power outages, or internet failures.

18. Dispute Resolution; Arbitration; Class Action Waiver

Most customer issues can be resolved by contacting support at info@whitefoxapoth.com. If not, you agree that any dispute or claim arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration, rather than in court, except that you may assert claims in small claims court in State of Indiana, USA. YOU AND White Fox Apothecary EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. The arbitrator shall have exclusive authority to resolve disputes relating to interpretation, applicability, or enforceability of this arbitration agreement. This clause does not limit any statutory rights that cannot be waived.

19. Governing Law & Venue

These Terms and any disputes are governed by the laws of the State of Indiana, USA, without regard to conflict of law principles. Subject to the arbitration clause above, exclusive venue for permitted claims shall be in the state courts located in Hendricks County, Indiana or the federal court for the Southern District of Indiana.

20. Privacy

Use of the Services is also subject to our Privacy Policy, which explains how we collect, use, and share information. By using the Services, you consent to the practices described in the Privacy Policy. For questions, contact info@whitefoxapoth.com.

21. Termination

We may suspend or terminate your access to the Services at any time, for any reason, including violation of these Terms or suspected fraudulent activity. Upon termination, all rights granted to you will cease immediately, and certain provisions (e.g., intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution) will survive.

22. Changes to Terms

We may update these Terms at any time by posting the revised version on the website and updating the Effective Date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

23. Notices

We may provide notices to you via email, account notifications, or by posting on the website. You may provide notices to us at info@whitefoxapoth.com.

24. Severability & Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

25. Entire Agreement

These Terms, together with the Privacy Policy and Return & Exchange Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior agreements or communications.
